How Liability Can be Confusing in a Multi-Car Accident

When a road accident involves one vehicle running off the road, into an object, or two cars colliding, it’s easier to determine liability. However, it becomes far trickier to determine liability in a multi-vehicle accident, even for experienced police officers and insurance adjusters. After all, each driver is likely to have their own story of what happened, and witnesses aren’t always reliable.

While there are a few exceptions, the police officers investigating the accident are usually responsible for determining how the accident happened and the person at fault. Car Insurance agencies go through all the evidence to determine if the police officers were correct in their assessment. You should take photos and videos yourself and not rely on other people to take pictures. The other driver will have pictures and videos, but you need your own.

Causes of Multi-Vehicular Accidents

There are many reasons there are multiple vehicles involved in the same accident. These reasons include:

  • Condition of the road itself (potholes, dangerous intersection, etc.)
  • Distracted driving
  • Drowsy driving
  • Impaired driving
  • Speeding
  • Tailgating
  • Weather

What to Expect and How To Protect Yourself After A Multi-Vehicle Accident

Keep in mind that your version of how the accident happened may differ significantly from how another driver or witness said it happened. They may even state you were at fault for the accident. Even if you’re sure you weren’t at fault, don’t start or engage in any arguments.

Don’t admit fault at the accident scene, and don’t say that you’ll pay for damages. Take pictures and videos of the accident, and get the license plate and insurance information. Obtain a copy of the police report and witness statements and ask if other drivers have traffic violation citations. Send all the information to your insurance company.
